1. Acceptance of Terms
By accessing or using Mitami ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years old to use Mitami. If you are under 18, you must have parental or guardian consent.
2. Nature of the Service
Mitami provides AI-powered companion conversations. Our companions are artificial intelligence — not real people, therapists, doctors, or counsellors. All responses are AI-generated and should be treated as such. Mitami companions are not a substitute for professional mental health support, medical advice, or human relationships.
3. AI Disclosure
In accordance with applicable law (including California SB 243 and similar regulations), we disclose that: (a) all companions on Mitami are AI systems, not humans; (b) companions do not have genuine emotions, consciousness, or independent existence; (c) the AI cannot make decisions, commitments, or legal agreements on our behalf; (d) responses may be inaccurate, outdated, or inappropriate — always apply your own judgment.
4. Content Policy
You agree not to use Mitami to: generate or solicit sexually explicit, violent, or harmful content; harass, abuse, or impersonate others; attempt to extract personal data about other users; reverse-engineer or circumvent safety systems; create companions designed to harm, deceive, or manipulate others; or use the Service for any illegal purpose. Violations may result in immediate account suspension without refund.
5. No NSFW or Adult Content
Mitami does not permit sexual, romantic, or explicit content of any kind. This is a firm platform-wide policy, not a configurable setting. Companions are designed to be thoughtful and supportive — not romantic partners or sources of adult entertainment. Attempts to bypass this policy through prompt engineering, character creation, or other means will result in account termination.
6. Mental Health & Crisis Policy
Mitami is not a mental health platform and does not provide therapy, counselling, or crisis intervention services. If you are in crisis or experiencing suicidal thoughts, please contact: 988 Suicide & Crisis Lifeline (call or text 988 in the US); Crisis Text Line (text HOME to 741741); or your local emergency services. Mitami has automated detection for crisis signals and will display resource information, but this is supplementary — not a replacement for professional help.
7. Subscription & Billing
Paid subscriptions are billed through LemonSqueezy. By subscribing, you authorise recurring charges at the selected billing cycle. Cancellations take effect at the end of the current billing period — no pro-rated refunds. Pricing may change with 30 days notice. All charges are in USD.
8. Data & Privacy
Your conversations are stored locally on your device and optionally synced to your private account. We do not sell your data or use conversation content for AI training. See our Privacy Policy for full details. You may delete your account and all associated data at any time from Settings → Profile → Danger Zone.
9. Intellectual Property
Content you create (companions, conversation text) remains yours. You grant Mitami a limited licence to store and process your content to provide the Service. Mitami's platform, code, design, and brand are our intellectual property. You may not copy, resell, or redistribute the platform without written permission.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranty of any kind. Mitami is not liable for: inaccurate AI responses; decisions you make based on AI output; emotional distress arising from companion interactions; or data loss due to technical failures. To the maximum extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may close your account at any time. Upon termination, your access ends immediately and we will delete your data in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms at any time. Significant changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Mitami operates. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration. Class action lawsuits are waived to the extent permitted by law.
